Terms of Use
These terms cover the public website at https://www.clubconsole.com.au and the hosted Club Console software. By using either, you agree to them. Privacy is described in the Privacy Policy. Questions: support@clubconsole.com.au.
The website
The marketing site is information about Club Console. It is not a contract to supply the product until we agree otherwise in writing. Demo requests are an enquiry, not a paid subscription.
The product
Club Console is hosted software for sports club administration. We grant authorised users a limited, non-exclusive, non-transferable right to use the service for the club’s internal operations during the term of the club’s arrangement with us.
Clubs are responsible for the data they enter, for who they give access to, and for complying with privacy, child-safety, and other laws that apply to them. That includes telling members how the club uses the product and having a lawful basis to collect information about young people.
Acceptable use
You must not:
- Probe, overload, or disrupt the service, or attempt to bypass security or access controls
- Use the service to send unlawful, misleading, or unsolicited bulk messages
- Upload malware or content you do not have the right to use
- Resell or misuse another club’s data
We may suspend access if we reasonably believe these terms, the law, or the security of the service is at risk.
Intellectual property
We and our licensors own the software, branding, and website content. Clubs own the records they put into the product. You may not copy, reverse engineer, or reuse our software except as the law allows.
Availability and liability
We aim to keep the service available and take reasonable care, but we do not warrant that it will be uninterrupted or error-free. To the extent permitted by the Australian Consumer Law and other non-excludable rights, our liability for the website and the product is limited to resupplying the services or paying the cost of resupply, and we are not liable for indirect or consequential loss. Nothing in these terms excludes rights you cannot contract out of.
Governing law
These terms are governed by the laws of Australia. If a dispute arises, the courts of New South Wales (and the Commonwealth) have jurisdiction, without limiting any non-excludable consumer rights.
Changes
We may update these terms. The date at the top is the latest version. Continued use after a change is posted on this page constitutes acceptance of the updated terms.
